Terms of Service

This Terms of Service Agreement (“Agreement”) governs your use of all services provided by Komfot Digital Health Limited (“Komfot Health,” “we,” “us,” or “our”), including but not limited to our website (www.komfothealth.com), mobile and web-based applications, and any associated tools, content, communication features, counseling services, scheduling interfaces, documentation, software, and other technologies offered via these platforms (collectively, the “Services”).

By accessing or using our Services, you agree to be legally bound by this Agreement, ourPrivacy Policy, and any additional guidelines, rules, or terms that may apply to specific offerings made available through our Services. If you do not agree to this Agreement, please do not use the Services.

1. Term and Termination

This Agreement remains in effect from the time you begin using the Services until terminated. You may terminate this Agreement at any time by discontinuing use of the Services. Komfot Health reserves the right to suspend, restrict, or terminate your access to the Services for any reason, including but not limited to violation of this Agreement, fraud, abuse, or behavior that is harmful to our users or platform.

Upon termination, your right to use the Services will immediately cease. You understand that termination may involve deletion of your account and all data associated with it. We are not liable for any consequences resulting from such deletion.

2. Modifications to the Agreement

Komfot Health may revise this Agreement at any time without prior notice. We will post changes to this Agreement on our website, and those changes will take effect immediately upon posting. It is your responsibility to review the Agreement periodically. Continued use of the Services after changes have been made constitutes your acceptance of the revised terms.

3. Eligibility

You may use the Services only if you:

  • Are at least 18 years of age (or the age of legal majority in your jurisdiction)
  • Are legally competent to enter into a binding agreement
  • Are located in Nigeria or another country where Komfot Health operates and complies with applicable laws
  • Are not prohibited by law from using the Services

We do not knowingly collect or process data from users under 18 without parental or guardian consent.

4. Registration and Account Security

To access certain Services, you may be required to register an account. When registering, you agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of your login credentials
  • Notify us immediately of unauthorized access or breach
  • Be solely responsible for activity under your account

Komfot Health reserves the right to suspend or terminate your account at its discretion, including but not limited to suspected fraud, unauthorized access, or breach of these Terms.

5. Services Provided

Komfot Health offers digital post-abortion and reproductive healthcare support, including:

  • Remote consultations with trained professionals
  • Booking of clinical services including evacuation procedures
  • STI screening and contraceptive services
  • Virtual therapy and psychosocial counseling
  • Confidential medical information storage and access
  • Patient education and wellness content

While the Services are delivered remotely, our care is rooted in safety, respect, privacy, and adherence to professional healthcare standards.

6. No Emergency Services

Komfot Health does not provide emergency medical services. Our services are not a substitute for clinical diagnosis or emergency care. If you experience symptoms such as severe bleeding, unconsciousness, suicidal ideation, or any medical emergency, contact emergency responders or go to a hospital immediately.

7. Privacy and Data Collection

Komfot Health collects, stores, and processes your personal data in accordance with our Privacy Policy. This includes data related to your health, communications, preferences, location (when allowed), and Service usage. By using the Services, you consent to such collection and use.

Your data will never be sold. We uphold strict confidentiality, use encryption where applicable, and comply with Nigeria data protection Act (NDPA 2023).

8. Fees and Payment Terms

Some parts of the Services may require payment, such as booking procedures, ordering lab tests, or subscribing to a counseling plan. All applicable fees will be disclosed at the point of use.

By making payments, you agree to:

  • Provide accurate payment information
  • Pay all associated charges, including taxes
  • Authorize Komfot Health or its third-party payment processors to charge your chosen payment method.

9. User Conduct

By using the Services, you agree not to:

  • Use the Services in violation of Nigerian law or any applicable regulations
  • Upload or share content that is defamatory, threatening, misleading, or harmful
  • Impersonate another person or organization
  • Attempt to access or interfere with systems you are not authorized to use
  • Upload viruses, malware, or engage in disruptive activities
  • Misuse support resources or harass staff members

Violation of any of these terms may result in termination of access and reporting to authorities.

10. Intellectual Property

All trademarks, logos, designs, texts, images, videos, and software contained in the Services are the exclusive property of Komfot Health or its licensors. You may not copy, modify, publish, reverse-engineer, or use any part of the Services for commercial purposes without our express written consent.

11. User Content and Submissions

Users may contribute reviews, feedback, or other content to the platform (“User Content”). By submitting content, you:

  • Represent that the content is accurate and lawfully yours to share
  • Grant Komfot Health a non-exclusive, royalty-free license to use, display, and reproduce your content
  • Agree that your content does not violate the rights of any third party

We reserve the right to moderate or remove User Content at our discretion.

12. Availability and Modifications

We may update, modify, suspend, or discontinue any feature of the Services at any time. Availability may vary depending on region, device type, user account type, and connectivity. We will not be liable for any Service unavailability or limitations caused by such modifications

13. Third-Party Services and Links

The Services may link to or integrate with third-party platforms (e.g., WhatsApp, Paystack, Google Forms). Komfot Health is not responsible for the practices, content, or privacy policies of those platforms. You access them at your own risk.

14. Limitation of Liability

To the maximum extent permitted by law, Komfot Health will not be liable for:

  • Loss of data
  • Personal injury, harm, or mental distress
  • Business interruption
  • Technical errors or loss of connectivity
  • Any indirect, incidental, punitive, or consequential damages

Our liability is limited to the amount paid by you, if any, for the Services in the 6 months preceding the incident.

15. Medical Disclaimer

The Services are intended for informational and support purposes only. They are not a substitute for face-to-face clinical diagnosis, emergency intervention, or long-term medical treatment.

Always seek professional medical advice before making decisions regarding your health. Komfot Health disclaims any liability related to the medical information, health assessments, or guidance provided through the platform.

16. Cancellation and Refund Policy

16.1. Service Cancellation

You may cancel appointments, therapy sessions, or other scheduled services via your Komfot Health dashboard or by contacting our support team. Cancellations must be made at least 24 hours in advance of the scheduled time to avoid any charges.

For services booked less than 24 hours in advance, cancellation must occur within 2 hours of booking.

Komfot Health reserves the right to cancel any scheduled service due to unforeseen provider unavailability or technical limitations. In such cases, you will be notified and offered a rescheduled appointment or a refund.

16.2. Refunds

All payments made for digital services, including but not limited to consultations, therapy, lab bookings, and contraceptive services, are non-refundable once the service has been rendered.

Refunds will only be considered in the following cases:

  • If a service was paid for but not delivered due to a technical or provider issue
  • If a duplicate payment was made for the same service
  • If cancellation is made at least 24 hours before the scheduled time, and no part of the service has been used

Approved refunds will be processed within 7 business days and returned via the original payment method.

16.3. No Show Policy

If you fail to attend a scheduled session without prior notice (no-show), Komfot Health reserves the right to withhold any refund and may limit future bookings.

17. Governing Law and Dispute Resolution

This Agreement and all disputes shall be governed by the laws of the Federal Republic of Nigeria.

Any controversy, claim, or dispute arising out of or relating to this Agreement shall first be attempted to be resolved through good-faith mediation.

If not resolved within 30 days, the dispute shall be referred to binding arbitration in accordance with the Arbitration and Conciliation Act, Cap A18 Laws of the Federation of Nigeria 2004. The seat of arbitration shall be Abuja, Nigeria, and the proceedings shall be conducted in English.

You and Komfot Health agree that all disputes must be brought in your individual capacity and not as a class action.
